Terms

Terms of Service

The agreement between you and MorrowNest: how the service works, subscriptions, what we expect from you, and what you can expect from us.

Last updated October 11, 2026

Who we are and what this is

MorrowNest is provided by AppMinds.dev Inc., Behind Aya's Swiss Bakery, Sto. Niño, Puerto Galera, Oriental Mindoro 5203, Philippines ("we", "us"). These terms are a contract between you and us for the MorrowNest apps for iOS and Android, the recipient pages on the web and related services (the "service"). By creating an account or using the service you agree to them. If you do not agree, please do not use MorrowNest.

Our Privacy Policy explains how we handle personal data and forms part of how the service works. If you buy a subscription through Apple, the Apple standard EULA also applies (see "Apple's terms").

Who can use MorrowNest

  • 16 and older can create a full account.
  • 13 to 15: you can create an account only with a parent's approval. Your account stays "pending" until your parent connects with you in the app and approves it.
  • Under 13: you cannot sign up yourself. A parent or legal guardian can create a receive-only account for their child through the parent's own invite, so that the child can receive keepsakes made for them.
  • Parents and guardians are responsible for the use of the service by a child whose account they approve or link, and confirm that they have the authority to do so. The age you give us at sign-up has to be true.
  • You need to be able to enter into a binding contract where you live. The service is not intended for use in places where it would be unlawful.

Your account

You sign in with a one-time code sent to your email, or with Apple or Google. Keep access to that email account and your device secure. You are responsible for what happens under your account. Tell us at hello@appminds.dev if you think someone else has got into it. Give us accurate information, including your date of birth, and keep your email address up to date so that sign-in codes and notices reach you.

How MorrowNest works

You can create keepsakes (letters, photos, voice notes and short videos) for yourself, for people you love, and for your child, and seal them until a date, a birthday or an age milestone. Please understand these rules before you rely on them:

  • Sealed means sealed. Once a keepsake is sealed, nobody can read its content until it opens: not you, not a co-parent, not the recipient, and not us. You cannot ask us to open it early; we have no way to do it.
  • 24-hour undo. For 24 hours after sealing you can return a keepsake to a draft. After that, you cannot.
  • Moving the date. You can move an unlock date later, never earlier. The one exception is a keepsake you set up as a manual unlock ("I'll open it when the time is right"), which you open yourself after a confirmation step.
  • Milestone keepsakes for a child are append-only. Owners can keep adding entries for years, but nobody can read or change what was already added.
  • Delivery. At the unlock time, by default 09:00 in the recipient's time zone, we deliver the keepsake: into the app for a recipient with a linked account, by an email link for an email-only recipient, or by notifying you if we have no way to reach the recipient. We take care to deliver on time, but we cannot guarantee delivery to the minute, or that an email arrives, or that a recipient opens it. You are responsible for keeping recipient details correct. We remind you once a year to check recipient emails.
  • Delivered means theirs. Once a keepsake has been delivered, it is part of the recipient's archive too. They keep access and can export it, even if you later delete your account or stop paying.
  • Online service. MorrowNest works online. Drafts are saved to our servers. Keep your own copy of anything you cannot afford to lose; we do not promise that the service will always be available or free of errors, though we work to keep it reliable.

Your content

  • You own it. What you create stays yours (or your licensors'). We do not claim ownership of your letters, photos, voice notes or videos.
  • Licence to us. To run the service, you give us a worldwide, non-exclusive, royalty-free licence to store, encrypt, process (for example resize or convert media), back up, transmit and deliver your content, and to show it to the recipients you choose, for as long as we need to provide the service to you and your recipients. We do not use your content for advertising, for training AI models or to promote the service, and we do not publish it.
  • Your promises. You confirm that you have the right to upload your content, including photos and recordings of other people, and that it does not break the law or anyone's rights.
  • People in your content. Photos, voice notes and information about other people, including children, are shared on your responsibility. Only include people you are entitled to include. Parents may include their own children. See the Privacy Policy section "Other people's data".
  • Backups of your own. You can export your data at any time. Sealed content is excluded from an export until it opens.

Acceptable use

Please do not use MorrowNest to:

  • create, store or send anything unlawful, including child sexual abuse material (we will report it to the authorities), content that exploits or endangers minors, or content that incites violence or hatred;
  • harass, threaten, deceive, stalk or impersonate anyone, or send keepsakes to someone who has told you they do not want to hear from you;
  • upload malware, or try to break, probe or overload the service, or get around limits, rate limits or the sealing rules;
  • use the service for spam, advertising or any commercial mass mailing;
  • scrape the service, or look for or collect other users' information;
  • create accounts using false information or in breach of the age rules above;
  • resell or give access to the service in ways we have not allowed.

Because sealed content is not visible to us, we cannot check it in advance. We may look at content only when the law requires us to, or when it is reported to us after it has opened, and we may then remove it, close accounts and inform the authorities.

Premium subscriptions and purchases

MorrowNest is free to use with limits (for example, three active keepsakes, one child and one voice note per keepsake). MorrowNest Premium removes or raises those limits and adds features such as video, birthday series, a co-parent invite and more storage.

Plans and prices

At launch we offer: Monthly (US$5.99 per month), Annual (US$39.99 per year, with a 7-day free trial for eligible new subscribers) and Lifetime (US$199, paid once, no trial; a founding-member offer for a limited time after launch). The price in your local currency, including taxes, is shown in the store before you buy and is the price you pay. Prices vary by country. [CONFIRM: final prices before launch]

Payment goes through Apple or Google

You buy Premium inside the app through the Apple App Store or Google Play. The purchase is a contract with that store for the payment, and with us for the Premium features. We do not receive your card details. We use RevenueCat to check and sync your subscription status. There are no web purchases in this version.

Automatic renewal

Monthly and Annual subscriptions renew automatically for the same period and at the then-current price unless you cancel at least 24 hours before the end of the current period. Your store account is charged for renewal within 24 hours before the period ends. If we change a price, the store tells you and, where required, asks for your agreement before the new price applies to you.

Free trial

A free trial lets you try Premium before the first charge. If you do not cancel at least 24 hours before the trial ends, it turns into a paid subscription at the price shown when you started, and your store account is charged. A trial is offered once per Apple Account or Google account, and any unused part of a trial ends when you buy a subscription.

Cancelling

You manage and cancel subscriptions in your store account settings (Apple: Settings, your name, Subscriptions; Google Play: Payments and subscriptions). Deleting the app or your MorrowNest account does not cancel a subscription. Cancel in the store first. After you cancel, Premium stays active until the end of the period you paid for.

Refunds

Refunds for purchases are handled by Apple or Google under their policies, because they take the payment. Request a refund from them (for Apple at reportaproblem.apple.com, for Google through Google Play). We cannot refund store purchases ourselves. This does not affect any statutory rights you have as a consumer, for example the right of withdrawal for digital content where it applies; for the 14-day withdrawal right in the EU, the store's process applies, and if you start using digital content immediately, the right may end as the law provides. [CONFIRM: wording on the withdrawal right with counsel]

If your Premium ends

A lapsed or cancelled subscription never locks you out. Your sealed keepsakes still open on time and stay readable. Only new Premium actions stop: for example creating more keepsakes than the free limit allows, adding videos, or creating series. Content that already exists is not deleted because your subscription ended. Premium includes 50 GB of storage under fair use; if you are above the free storage limit after Premium ends, you can keep opening and exporting everything, but you cannot add new media until you are back under the limit or resubscribe.

Lifetime

Lifetime is a one-time purchase, where offered, that unlocks Premium for as long as we offer the service. It includes the same 50 GB fair-use storage as other Premium plans. It is not a promise to keep the service running forever. If we ever stop the service, we will give you reasonable notice and a way to export your data. Lifetime is a founding offer for a limited time: we show until when in the app, and after that date it is no longer offered. We may change or stop offering Lifetime for new buyers at any time; that does not affect those who already bought it. [CONFIRM: wording on lifetime with counsel]

Shared Premium for a child

If you or a co-parent has Premium, the child's archive has Premium features. This does not extend to the other person's other keepsakes.

Fair use

The storage included in Premium (currently 50 GB) is for personal family keepsakes. We may contact you if use is far beyond normal.

Apple's terms

If you got MorrowNest from the Apple App Store, then in addition to these terms the Apple Standard EULA ("Licensed Application End User License Agreement") applies between you and Apple. If these terms and the standard EULA conflict, the standard EULA prevails for matters it covers. You acknowledge that these terms are between you and us, not Apple, and that Apple is not responsible for the app, its content, support, maintenance or warranty claims, and is a third-party beneficiary of the EULA. Apple has no obligation to provide maintenance or support for the app.

If you got MorrowNest from Google Play, the Google Play Terms of Service apply to your use of the store. Google is not a party to these terms.

Ending your use

  • You can stop using MorrowNest and delete your account at any time in the app (Profile, Privacy and security). Cancel any subscription in the store as well.
  • We can suspend or close an account, with notice where possible, if you seriously or repeatedly break these terms or the law, if it is necessary to protect others (especially children), or if we must by law. If we close your account without a serious reason, we will give you reasonable notice and a way to export your data, and refund any prepaid subscription time we are responsible for, as far as the stores allow.
  • Pending keepsakes. When your account ends we ask whether pending keepsakes should still be delivered (the default is yes). If yes, we keep only what delivery needs and deliver them on their day. Delivered keepsakes remain with their recipients. See "Deleting your account and pending keepsakes" in the Privacy Policy.
  • Provisions that by their nature should survive, such as ownership, the licence to deliver, liability and governing law, continue after the contract ends.

Changes to the service and these terms

We keep improving MorrowNest and may add, change or remove features. We will not remove a feature you paid for without a fair remedy. We may update these terms, for example for new features or legal changes. We will tell you about important changes in the app or by email in advance, and the new terms apply from the date stated. If you do not agree, you can delete your account before then. Continuing to use the service after that date means you accept the new terms.

Warranty and liability

We provide the service with reasonable care and skill. Beyond what the law requires, we give no promise that it will be uninterrupted, error-free or fit for a particular purpose. Memories are precious: please keep your own backups of anything irreplaceable.

Nothing in these terms limits our liability for intent or gross negligence, for injury to life, body or health, for anything we cannot limit by law, or any statutory rights you have as a consumer. Subject to that, we are liable for slight negligence only for breach of a material obligation (one on which you may regularly rely), and then only for foreseeable damage typical for this kind of contract. We are not responsible for losses caused by things outside our control, such as problems with the stores, internet or email providers, or incorrect recipient details you gave us. [CONFIRM: liability clause with counsel for the chosen jurisdiction]

Governing law and disputes

These terms are governed by the laws of the Republic of the Philippines [CONFIRM: governing law choice], without its conflict-of-law rules. If you are a consumer, you also keep the mandatory consumer protection rights of the country where you live, and you may bring a claim in the courts of that country. Otherwise the courts of Oriental Mindoro, Philippines [CONFIRM: venue] have jurisdiction, as far as the law allows.

The EU provides an online platform for dispute resolution at ec.europa.eu/consumers/odr. We are not obliged to take part, and are not willing to take part, in dispute resolution proceedings before a consumer arbitration board. Please write to us first and we will try to resolve it.
